1. The Indian reservation gambling trend began in Florida in the 70s when the Seminole tribe opened a high-stakes bingo operation that was against Florida law. The authorities immediately tried to close the tourist attraction and many incidents followed. In 1979, the Supreme Court ruled that states did not have the right to regulate Indian reservation activities and that they could not impose taxes on the occupation of reservations.

In the 1987 Cabazon decision, the Supreme Court ruled that a state could not regulate an activity on a reservation unless some form of gambling was illegal in the state where the reservation was located. The decision is related to the Indian Gaming Regulatory Act, which requires a reservation conference with the state before offering any games to be played against casinos, such as slots or blackjack tables. If the state refuses to negotiate — as many do — then the interior secretary makes his case, which always favors the Indian tribe.

3. Indian reservation gambling generates more revenue than Atlantic City and Las Vegas. In 2009, 425 facilities operated by 233 tribes in 28 states had a total revenue of $26.5 billion. Tribes receive $4 of every $10 that Americans wager in casinos.

Donald Trump also tried his hand at managing a reservation casino when he owned and operated the Trump 29 casino in California. It was the first California reservation casino to open under a non-Indian name; The Trump property was demolished in 2006 and is now called Spotlight 29.

7. Game proceeds are to be used only for tribal government and charitable projects. Income is exempt from federal, state and local taxes, but there are exceptions. In cases where revenue is split equally and then distributed directly to tribal members, the federal government gets a nice cut. State taxes are often part of large-scale casino deals.
8. There are 562 recognized tribes in the United States, of which only 200 operate full-scale casinos. There are about 150 additional tribes that should be recognized. Many complain that these tribes have no real members and just want to make money from the casino business. Native American rights advocates point to centuries-old treaties designed to protect these unrecognized tribes. The Pequot tribe that runs the Foxwoods was recognized in the early 1980s, when the last living member living on the reservation died and his descendants came together to rebuild the tribe.
9. In the mid-90s, the Coeur d’Alene tribe in Idaho launched the National Indian Lottery online. It was a revolutionary idea at the time. But this was met with many protests and many lawsuits. They became suspicious! (Skinwalkers are people who practice a form of witchcraft in Native American legend.) Tribal leadership decided to move forward with the project, and in November 2008, the casino opened to much fanfare. However, early in the morning, reports surfaced that workers had spotted skinwalkers in the casino on opening day. Navajo Gaming Enterprise CEO Robert Winter assured visitors that the tribe has blessed the casino resort with many security blessings, making it a great place to visit. 🙂
